WYR? — Terms of Service & End User License Agreement
Effective date: July 9, 2026
Welcome to WYR? ("WYR?," the "App," "we," "us," or "our," operated by Mayer Sancivieri). These Terms of Service and End User License Agreement (together, the "Terms") are a binding agreement between you and WYR? governing your use of the App and its features, including the community pack library. Please read them carefully.
By downloading, accessing, or using WYR?, you agree to these Terms. If you do not agree, do not use the App.
If you use community features (publishing, browsing, or installing community packs), you also agree to our Community Guidelines, which are incorporated into these Terms.
1. Who can use WYR?
You must be at least 18 years old (or the age of majority where you live) to use WYR?. By using the App you represent that you meet this requirement. WYR? is intended for couples and contains mature, flirtatious themes; it is rated 17+ on the App Store.
2. Your account and your duo
WYR? pairs two people into a "duo." You are responsible for activity that occurs through your account and for keeping your sign-in credentials secure. You may not impersonate anyone or misrepresent your identity.
3. The service
WYR? lets couples answer "Would You WYR?" prompts, record shareable reels, create custom question packs, and — through the community library — publish their packs for other couples and install packs others have published. We may add, change, or remove features at any time.
4. Subscriptions and payments (WYR? Pro)
Some features require a paid subscription ("WYR? Pro"). Subscriptions are sold through the Apple App Store and are subject to Apple's terms. Auto‑renewing subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; manage or cancel in your Apple account settings. Prices may change with notice. Except where required by law or Apple policy, payments are non‑refundable.
5. User‑generated content and the community library
The WYR? community library lets you publish text question packs ("Your Content") and install packs published by others. This Section governs all user‑generated content.
5.1 You are responsible for Your Content
You are solely responsible for anything you publish. You represent that you own or have the rights to Your Content and that it does not violate these Terms, the Community Guidelines, or any law or third‑party right.
5.2 License you grant
When you publish a pack, you grant WYR? and other users a worldwide, non‑exclusive, royalty‑free license to host, store, reproduce, display, distribute, and — for users who install it — copy Your Content within the App for the purpose of operating and providing WYR?. Publishing creates independent copies: when another couple installs your pack, they receive their own copy, and later edits, unpublishing, or removal by us or you do not automatically retract copies already installed on other devices. You retain ownership of Your Content.
5.3 Zero‑tolerance policy for objectionable content
There is zero tolerance for objectionable content or abusive behavior. You may not publish, and Your Content may not contain, anything that:
- is sexually explicit or pornographic, or that sexualizes, depicts, or endangers minors in any way;
- is hateful, harassing, threatening, defamatory, or that promotes violence, self‑harm, or discrimination against people based on race, ethnicity, national origin, religion, disability, gender, gender identity, sexual orientation, age, or any protected characteristic;
- exposes another person's private or personally identifying information ("doxxing");
- is illegal, promotes illegal acts, or facilitates fraud;
- infringes anyone's intellectual property or other rights;
- is spam, a scam, malware, or otherwise deceptive or manipulative.
5.4 Our moderation rights
We may review, filter, refuse, hide, remove, or restrict any content, and suspend or permanently ban any user, at any time and without prior notice, at our sole discretion — including through automated filtering at publish time and automatic hiding of reported content. We are not obligated to publish or preserve any content.
5.5 Reporting and our commitment to act
Every community pack includes a Report control (••• → Report). You can also contact us at support@thewyrapp.com to report objectionable content or abusive users. Reported packs are automatically hidden pending review. We will review reports and remove violating content and eject the users who provided it, generally within 24 hours.
5.6 Blocking
You can block any publisher from a pack's ••• menu. Once blocked, you will no longer see that publisher's packs. Blocking is one‑directional and immediate.
5.7 No expectation of privacy for published content
Content you choose to publish to the community is visible to other users. Do not publish anything you consider private. (Your recorded reels are never part of the community library and are not shared through it.)
6. Acceptable use
You agree not to: use the App for any unlawful purpose; harass, abuse, or harm another person; attempt to access accounts, data, or systems you are not authorized to access; probe, scan, or test the vulnerability of our systems; scrape, reverse engineer, or circumvent security or rate limits; or interfere with the App's operation. Violations may result in immediate suspension or termination.
7. Intellectual property
The App, its design, and its original content (excluding user‑generated content) are owned by WYR? and protected by law. We grant you a limited, non‑exclusive, non‑transferable, revocable license to use the App for personal, non‑commercial purposes under these Terms. If you believe content in the App infringes your copyright, contact support@thewyrapp.com with details sufficient to identify the work and the allegedly infringing material, and we will respond appropriately.
8. Termination
You may stop using the App at any time. We may suspend or terminate your access at any time, with or without notice, including for any violation of these Terms. Sections that by their nature should survive termination (including Sections 5, 7, 9, 10, and 11) survive.
9. Disclaimers
THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. We do not warrant that the App will be uninterrupted, secure, or error‑free, or that user‑generated content is accurate, appropriate, or lawful. Community packs are created by other users; we do not endorse them.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WYR? WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP OR ANY USER‑GENERATED CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US $50.
11. Indemnification
You agree to indemnify and hold harmless WYR? from any claims, damages, losses, and expenses (including reasonable legal fees) arising from Your Content, your use of the App, or your violation of these Terms or the rights of any third party.
12. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date and, where appropriate, notify you in the App. Your continued use after changes take effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict‑of‑laws rules, except where local consumer‑protection law provides otherwise.
14. Apple App Store additional terms
These Terms are between you and WYR? only, not with Apple. Apple is not responsible for the App or its content. To the extent required by Apple:
- Your license to use the App is a non‑transferable license to use it on any Apple‑branded device you own or control, as permitted by the App Store Terms of Service.
- Apple has no obligation to provide maintenance or support for the App.
- To the maximum extent permitted by law, Apple has no warranty obligation for the App, and any claims of non‑conformance to warranty are our responsibility, not Apple's.
- Apple is not responsible for addressing any claims by you or a third party relating to the App, including product‑liability, legal‑or‑regulatory, or consumer‑protection claims.
- Apple and its subsidiaries are third‑party beneficiaries of these Terms and may enforce them against you.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist‑supporting," and are not on any U.S. Government restricted‑party list.
